Version 1.0, effective 13 October 2026.
Terms of service
These terms are the agreement between you and Freehold Mail. We've kept them short and in plain language. Where they say "we", they mean Thomas van Otterloo, Libanonstraat 12, Delft, the Netherlands, who runs Freehold Mail.
1. The service
Freehold Mail gives you email addresses, a mailbox, and the tools to decide where your mail goes: keep it here, forward it, relay it to your own server, or take it with you. You can use addresses on freeholdmail.com and on domains you own.
Freehold Mail is in early access. Accounts are free and available by invitation only. We'll tell you at least 90 days in advance if we start charging, and you can leave before then without paying anything.
2. Your account
- You must be at least 16 years old.
- Keep your sign-in details safe. You're responsible for what happens with your account unless it was our fault.
- Give us a contact address that works, so we can reach you about your account.
- An invitation is personal: don't sell or publish it.
3. Your data stays yours
Everything you store with us (mail, contacts, calendars, filters) is yours. We only use it to provide the service to you. You can export all of it at any time in standard formats, and you can leave whenever you want. How we handle personal data is described in the privacy policy. If you use Freehold Mail for your business, the data processing agreement is part of these terms.
Addresses on freeholdmail.com are never given to anyone else, also not after you leave. Domains you add stay yours; we only use them for your mail while they are connected to your account.
4. Acceptable use
Our mail servers are shared, and their reputation is what lets everyone's mail arrive. So you may not use Freehold Mail to:
- send spam, meaning bulk or commercial mail to people who didn't ask for it, or mail to purchased or scraped lists;
- send phishing, malware, or mail that pretends to come from someone else;
- break the law, or infringe other people's rights;
- harass or threaten people;
- try to get around sending limits, break into other accounts, or attack our systems or anyone else's.
New accounts can send up to 20 messages per day for the first 7 days, and every account has a daily sending limit to protect the shared servers.
5. When we may pause or close your account
If an account sends mail that bounces or is reported as spam far more than normal, sending is paused automatically (see "Automated decisions" in the privacy policy). Receiving, reading and exporting your mail keep working. Write to abuse@freeholdmail.com and a person reviews it.
We may also pause sending, or close an account, if it seriously or repeatedly breaks these terms, or if the law requires it. Except in urgent cases (ongoing abuse, a legal order, a security risk), we warn you first and give you time to respond. If we close your account, you can still export your data for at least 30 days, unless a legal order prevents it.
6. Leaving
You can leave at any time from your account settings. We give you a full export first, then close the account and delete your mailbox data 30 days later. Addresses on freeholdmail.com that you've set to forward can keep forwarding after you leave.
7. If we stop
If we ever stop running Freehold Mail, or hand it over to someone else, we will tell you at least 90 days in advance. Our shutdown promise says what happens in those 90 days.
8. Availability and changes to the service
We work hard to keep Freehold Mail running and your data safe, with encrypted mail storage and daily backups. But it is a free early-access service run by a small operator, and we can't promise it will never be interrupted. Planned maintenance and incidents are shown on our status page.
We may change or improve features. If a change takes away something important you rely on, we'll tell you in advance.
9. Liability
We are not liable for indirect damage, such as lost profit or missed opportunities, or for damage caused by things outside our control. Our total liability is limited to €100 per year. These limits don't apply to damage caused intentionally or by gross negligence, or where the law doesn't allow them, and they don't take away any rights you have as a consumer under mandatory law.
You are responsible for what you send. If someone holds us liable because you broke these terms, you cover that damage.
10. Changes to these terms
We'll email you at least 30 days before a change that affects you. If you don't agree, you can leave before the change takes effect.
11. Law and disputes
Dutch law applies. If we can't solve a disagreement together, it goes to the competent court in The Hague, the Netherlands. If you are a consumer, you can also use the courts of the place where you live, and the mandatory consumer protections of your own country keep applying.
